The Web site is owned by Jobs4point0.com, LLC d/b/a Jobs4.0. (“Jobs4.0”). Jobs4.0 owns (or licenses) all the wallpaper, characters, artwork, icons, graphics, text, and other content on this site ("Content"), and all HTML, CGI, and other code and scripts in any format used to implement these sites ("Code"). You may not copy, modify, upload, download, transmit, (re)publish, or otherwise distribute any Code or Content from this site except as expressly permitted by these rules and the instructions for each section of the site. You may not modify or use the Content or Code you receive from the site for any purpose other than those permitted, and doing so will violate Jobs4.0’s copyright and other proprietary rights.
JOBS4.0 performance of this agreement is subject to existing laws and legal process and nothing contained in this agreement is in derogation of JOBS4.0's right to comply with law enforcement requests or requirements relating to the user's use of these sites or information provided to or gathered by JOBS4.0 with respect to such use.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
This agreement constitutes the entire agreement between the user and JOBS4.0 with respect to these sites and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and JOBS4.0 with respect to these sites. A printed version of this agreement and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained conjunction with JOBS4.0.
If any portion of the site permits you to download Content, the above restrictions generally apply. You may, however, download one copy of the Content on any single computer for your personal, non-commercial use only, In doing so, you must not remove or modify any of the copyright, trademark, and other proprietary notices. We retain all rights to any Content you download, and grant you a limited license to use them only as described above.
Some portions of our site may provide you with access to other sites and/or email addresses, either by means of a direct link or through a software script (collectively, "Click-Thru Access"). Nevertheless, to avoid any disputes we must ask you not to send us anything unless you agree that we will own what you send. Specifically, all suggestions, ideas, concepts, messages, emails, samples, and all other Content or submissions (collectively "Submissions") shall be deemed, and shall remain, the property of JOBS4.0 and you hereby assign all rights in the Submissions to JOBS4.0. If for any reason any rights in any Submissions are not assigned, you hereby grant JOBS4.0 a perpetual, irrevocable, fully paid license to use the Submissions for any purpose whatsoever. You also hereby give your consent for JOBS4.0 to use your name in connection with your Submissions, or for promotional purposes, unless you specify otherwise at the time of submission.
USE OF OUR JOB POSTINGS SERVICE AND OTHER COMMUNICATIONS FORUMS
For all job postings, and to the extent the site contains messages or communication links ("Site Facilities"), the user agrees to use such Site Facilities only to post legitimate job opportunities and for no other purpose. By way of example, and not as a limitation, the user shall not:
Defame, abuse, harass, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent, offensive or unlawful material or information.
Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless the user owns or controls the rights thereto or has received all necessary consents.
Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another person's computer.
Falsify the origin or source of software or other material contained in a file that is uploaded.
Advertise or offer to sell any goods or services, or engage in surveys, contests, chain letters or for any commercial purpose.
Download any file that the user knows, or reasonably should know, cannot be legally distributed via these sites.
The job posting feature of Jobs4.0 may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees.
Jobs4.0 specifically prohibits any other use of Jobs4.0, and all users agree not to do any of the following: (a) post any jobs on Jobs4.0 for any other on-line job board or any other service or facility that could reasonably considered a competitor of Jobs4.0, (b) post jobs or other content that contains links to any on-line job board or any other service or facility that may be competitive with Jobs4.0; (c) post jobs or content on Jobs4.0 that contains any hyperlinks, "hidden" keywords or any keywords that are irrelevant to the job or are otherwise misleading contained in a job posting; (d) post jobs for positions that Jobs4.0 deems inappropriate for its site; (e) post or submit to Jobs4.0 any incomplete, false or inaccurate biographical information or information which is not your own; (g) post any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (except for postings that make clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling, in which case such postings are permissible), requires recruitment of other members, sub-distributors or sub-agents; (h) send unsolicited mail or e-mail, make unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to a user of Jobs4.0; (i) delete or revise any material posted by any other person or entity; (j) take any action that imposes an unreasonable or disproportionately large load on Jobs4.0’s infrastructure; (k) notwithstanding anything to the contrary contained herein, use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search Jobs4.0’s website other than the search engine and search agents available from Jobs4point0.com’s website and other than generally available third party web browsers (e.g., Netscape Navigator, Microsoft Explorer); (l) attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of Jobs4point0.com’s website; (m) aggregate, copy or duplicate in any manner any of the content found on the Jobs4point0.com website or any information available from our site; or (n) take any other action that may harm the functionality, design or aesthetics of Jobs4point0.com.
